LYL Inventories Ltd – Terms and Conditions of Service

These Terms and Conditions (“Terms”) govern the provision of property inventory services by LYL Inventories Ltd (“we,” “us,” “our”) to clients (“you,” “your”). By instructing us to perform services, you agree to these Terms. Please read them carefully, as they form a legally binding agreement.
1. Definitions
- Service: The property inventory services provided by LYL Inventories Ltd, including but not limited to inventory reports, check-in/check-out reports, and interim inspections.
- Report: A documented record of the property’s condition and inventory as assessed during the inspection.
- Client: The individual, agent, or company instructing LYL Inventories Ltd to provide services.
- Property: The premises where our services are conducted.
2. Scope of Services
We provide property inventory-related services, including but not limited to inventory reports, check-in/check-out inspections, and interim inspections. The scope of each service will be agreed upon in advance, and our reports represent a factual record of the property’s condition and contents as observed at the time of inspection.
3. Booking and Confirmation of Services
- Booking: To book a service, please contact us via phone, email, or our website. We will confirm availability and send a booking confirmation.
- Acceptance of Terms: By booking our services, you accept these Terms in full, unless otherwise agreed in writing.
- Amendments: Any changes to your booking, including date, time, or scope of service, must be requested at least 48 hours before the scheduled inspection.
4. Pricing and Payment
- Fees: Fees for services are based on our published rate schedule or as quoted during booking. Prices are subject to VAT unless otherwise specified.
- Payment Terms: Full payment is due within 14 days of the invoice date unless otherwise agreed in writing.
- Late Payment: If payment is not received by the due date, we reserve the right to charge interest at a rate of 8% per annum above the Bank of England base rate, accruing daily from the due date until payment is received in full.
- Additional Costs: If additional time or resources are required due to unforeseen circumstances, an additional fee may apply. We will notify you of any extra charges as soon as possible.
5. Cancellation and Rescheduling Policy
- Cancellation:
- More than 48 hours before service: No cancellation fee.
- 24 to 48 hours before service: 50% of the service fee is payable.
- Less than 24 hours before service: 100% of the service fee is payable.
- Rescheduling: Rescheduling is allowed with at least 48 hours’ notice. Rescheduling requests made within 24 hours of the scheduled service may incur a 25% rescheduling fee.
6. Service Standards and Limitations
- Standard of Service: We strive to deliver accurate and comprehensive reports based on visible and accessible areas of the property. Our inspections do not include any intrusive or specialist testing (e.g., plumbing, electrical).
- Limitations of Inspection:
- We do not move heavy items or access lofts, basements, or locked rooms unless pre-arranged.
- Reports reflect the property’s condition at the time of inspection. We are not liable for changes occurring after the inspection date.
- Items or areas not visible or accessible are not inspected, and our report will note these exclusions.
7. Client Responsibilities
- Access to Property: The Client must ensure that the property is accessible at the scheduled inspection time. Failure to provide access may result in additional charges.
- Preparation: The Client is responsible for ensuring that the property is ready for inspection, including cleaning, removal of personal items, and informing us of any specific items to be inspected.
- Disclosure of Known Hazards: Clients must inform LYL Inventories Ltd of any known hazards at the property, such as asbestos, mold, or pest infestations.
- Accuracy of Information: Clients must provide accurate property information and necessary instructions to ensure a thorough inspection.
8. Limitations of Liability
- Accuracy of Reports: While we strive for accuracy, our reports are a visual and factual representation of the property at the time of inspection. We make no warranties or guarantees regarding the property’s condition beyond what is stated in the report.
- Exclusions of Liability: We are not liable for any loss, injury, or damage resulting from:
- Defects not visible at the time of inspection.
- Areas not accessible during the inspection.
- Issues arising after the inspection date.
- Maximum Liability: In any event, our total liability to you, whether in contract or tort, is limited to the fee paid for the specific service provided.
9. Confidentiality and Data Protection
- Confidentiality: All client information is treated as confidential, and we do not share personal information without consent unless required by law.
- Data Security: Personal data collected during our services is stored securely in accordance with the UK GDPR and Data Protection Act 2018. For more details, refer to our Privacy Policy.
- Data Retention: We retain inspection reports and client information for a period of six years unless otherwise required by law.
10. Intellectual Property
- Ownership of Reports: The contents of our reports are the intellectual property of LYL Inventories Ltd. Reports are provided for the exclusive use of the Client and may not be reproduced or shared without our prior written consent.
- Use of Company Materials: Any documents, templates, or intellectual property used during the inspection process remain the property of LYL Inventories Ltd.
11. Complaints and Dispute Resolution
- Complaints: We are committed to providing high-quality services. If you are dissatisfied, please refer to our Complaints Procedure and contact us in writing at info@lylinventories.com within 48 hours of receiving the report.
- Dispute Resolution: If a dispute arises, both parties agree to attempt resolution through informal discussions before escalating to formal mediation or legal action.
12. Amendments to Terms
LYL Inventories Ltd reserves the right to amend these Terms at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of updated Terms. Clients are encouraged to review these Terms periodically.
13. Force Majeure
LYL Inventories Ltd is not liable for any failure to perform its obligations due to events outside our reasonable control, such as natural disasters, severe weather, strikes, or government actions. In the event of a Force Majeure, we will inform you as soon as possible and take reasonable steps to resume services promptly.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Entire Agreement
These Terms, along with any booking confirmations and written agreements, constitute the entire agreement between LYL Inventories Ltd and the Client. If any part of these Terms is found unenforceable, all other provisions remain in effect.
